1. Introduction
Welcome to the Brisk Response App. These Terms and Conditions govern your use of our application and services. By using our app, you agree to comply with and be bound by these terms. If you do not agree with any part of these terms, please do not use our app.
2. Definitions
App: Refers to the Brisk Response App application.
User: Any individual using the app.
Informant: A user who reports incidents or emergencies.
Responder: A user or agency responding to reported incidents.
Agency: Government or other authorized entities registered in the app.
Content: All information, text, images, and other materials are provided through the app.
Brisk Agent's Intervention Time-frame (BAIT):The designated period within which Reported Incidents will be queued to Brisk Agents if the initial responders fail to address an incident immediately, then the Brisk Agents will try to get the attention of other Responders. All incident/emergency reports will be queued to assist with handling these incidents appropriately. Please take note that the BAIT is only suggested and is not a standard operating procedure of the Brisk Response App. The assistance of the Brisk Agents to the incidents may vary depending on the agent's availability and is not mandatory at this moment.
3. BAIT Tiers
Quartile 1:Immediate Response (1-3 minutes) Incidents: Residential Fire, Commercial Fire, Wildfire, Electrical Fire, Chemical Fire, Vehicle Fire, Kitchen Fire, Industrial Fire, Explosion, Active Shooter, Hostage Situation, Drowning, Severe Allergic Reaction, Severe Heatstroke, Severe Hypothermia, Bomb Threat Reason: These incidents pose an immediate threat to life and property and require swift action to mitigate harm.

Quartile 2: Urgent Response (4-15 minutes) Incidents: Structural Collapse, Aftershock, Tsunami Warning, Utility Disruption (Water/Gas/Electricity), Building Evacuation, Medical Emergency, Severe Poisoning, Severe Overdose, Severe Mental Health Crisis, Infectious Disease Outbreak, Flash Flood, Storm Surge. Reason: These incidents are urgent and have the potential to escalate rapidly, necessitating a quick but slightly longer response time than the most critical incidents.

Quartile 3: High Priority Response (16-30 minutes) Incidents: Burglary, Assault, Kidnapping, Domestic Violence, Sexual Assault, Stalking, Wanted Person, Death Threats, Vehicle Collision, Pedestrian Accident, Hit and Run, Road Hazard, Illegal Wildlife Trade, Human Trafficking, Organ Trafficking, Repatriation Concerns, Health Emergency (OFWs), Missing Person (OFWs) Reason: These incidents are serious and require timely intervention, but they are less immediate in threat compared to those in Quartile 1 and 2.

Quartile 4: Standard Response (31-60 minutes) Incidents: Fraud, Money Laundering, Drug-Related, Vandalism, Trespassing, Public Intoxication, Disorderly Conduct, Noise Complaint, Protests, Riots, Employment Issues (OFWs), Unpaid Wages (OFWs), Legal Assistance (OFWs), Over Pricing, Neglect of Senior Citizen Discount, Neglect of PWD Discount, False Advertising, Substandard Goods, Refund Issues, Service Denial, Unfair Business Practices, Misleading Pricing, Warranty Violations. Reason: These incidents are important and should be addressed promptly, but they do not pose an immediate threat to life or safety.
4. Permitted Use
The app is intended for reporting and responding to incidents, sharing news, and sending alerts. You agree to use it only for lawful purposes. Unauthorized use may lead to account suspension or legal action.
5. Prohibited Use
You may not use the app to engage in any activity that is unlawful, harmful, or disruptive to the app or other users. Prohibited activities include, but are not limited to:

Misusing the app to spread false or misleading information. Engaging in any form of harassment, abuse, or threats against other users. Attempting to gain unauthorized access to any part of the app or its underlying systems. Uploading or sharing content that contains viruses, malware, or any other harmful code. Violating the intellectual property rights of others.
6. Reporting and Responding to Incidents/Emergencies
Accuracy: Informants must provide accurate and truthful information when reporting incidents. False reports may result in account suspension or legal action.
Responsibility: Responder must act responsibly and in accordance with applicable laws and guidelines when handling incidents. Failure to do so may result in the loss of access to the app or other penalties.
7. Content
User Content: Users retain ownership of the content they submit. By submitting content, you grant us a license to use, modify, and display it as necessary to provide our services.
Prohibited Content: You may not submit content that is illegal, harmful, or violates the rights of others. We reserve the right to remove any content that violates these terms without prior notice.
8. Alerts and Notifications
Consent: By using the app, you consent to receive alerts and notifications. You can manage your preferences in the app settings.
Accuracy: We strive to provide accurate and timely alerts but do not guarantee their accuracy or timeliness. We are not liable for any actions taken based on the alerts or notifications provided by the app.
9. Liability
Disclaimer: The app is provided "as is" without warranties of any kind. We do not guarantee the accuracy, completeness, or reliability of the app or its content.
Limitation of Liability: We are not liable for any damages arising from your use of the app, including direct, indirect, incidental, or consequential damages. This limitation applies to the fullest extent permitted by law.
10. Modifications
Changes to Terms: We may modify these terms at any time. Changes will be effective upon posting on the app. Your continued use of the app constitutes acceptance of the modified terms.
11. Governing Law
Jurisdiction: These terms are governed by the laws of the Republic of the Philippines. Any disputes will be resolved in the courts of Iloilo City, Philippines, with the exemption of all other courts.

13. User's Additional T&C
Registration: Users must provide their complete name, phone number, email, and address to help with verification and ensure accurate details. Users cannot report incidents or emergencies without verification.
Verification: Verification requires valid ID scanning (front and back) and a selfie with the ID. Brisk Response reserves the right to reject verification if the ID or supporting documents do not match the registration details. Users must be 13 years old and above, with a National ID (Physical or Digital). Users with school IDs must re-verify every year. Registrants who are 17 years old and below cannot register an agency access.
Subscription: Users can purchase subscription plans for personal incident points. Users can buy Agency Slots on top of their 1 free agency slot. Prices may change without prior notice. See Subscription Plans
Refund/Cancellation: Refunds are only available within 24 hours if the points remain unused. Agency Slots are non-refundable once consumed (when the registered agency is verified).
Security: Users are responsible for maintaining the confidentiality of their account information and all activities under their account.
Termination: We reserve the right to suspend or terminate accounts for violations of these terms or any other reason at our discretion.
Accessing Report Incident/Emergency Feature: Please make sure that your account is verified by scanning a valid government-issued ID (e.g., driver's license, passport). This verification is essential for confirming your identity and maintaining the security of the platform. Provide your full residential address, along with the Barangay you reside in at Address Setup. This information is critical for enabling location-specific responses and ensuring effective community engagement.
Accessing Brisk Response News: By accessing Brisk Response News, you agree to view its content at your own discretion. We provide friendly reminders regarding the nature of the news, which may contain sensitive content. SPG (Strong Parental Guidance) is advised before accessing the news, and users under the age of 13 should have parental guidance.
Accessing Emergency Alerts: All emergency alerts posted or disseminated through the Brisk Response App are the sole responsibility of the respective agency. Any information related to rewards, fugitives, or missing persons should be directed to the agency that posted the alert. The Brisk Response App, its Team, and Management do not act as intermediaries for rewards or handling information regarding fugitives or missing persons. Users are encouraged to utilize the "Report" button to communicate directly with the agency responsible for the alert. Additionally, evacuation centers tagged or pinned by agencies on the Brisk Response App are managed solely by those agencies. To coordinate with an evacuation center, contact the agency directly. Please note that evacuation centers marked on the Brisk Response Map may not be visible on Google Maps or other web-based map services. The same applies to any voting precinct pinned by the agency, which may also not appear on conventional or web-based maps.
Threat Journal: By submitting your entry to the Threat Journal of the Brisk Response App, you agree that this information may be vital for any future investigations conducted by authorities. Your report will remain confidential and will only be accessed by law enforcement or the courts upon a valid and official request. Until such a request is made, your entry will remain private and securely stored.
Shared Media Contents: Any media content (photos, videos, etc.) shared, uploaded, or provided by users on the Brisk Response App is the sole responsibility of the user who shares it. Brisk Response App disclaims any liability for such content. This includes, but is not limited to, any media that captures individuals, groups, or entities, whether directly or indirectly, intentionally or unintentionally. Users are fully accountable for ensuring that their shared content complies with privacy and consent standards.
Brisk Map – Location Consent: By using Brisk Map, you consent to the app collecting your location for the following purposes:
1. Home Address – Used for reporting incidents and emergencies. This information will be shared with your chosen responders and any agencies handling escalations.
2. Agency Address – Allows users to easily find your office on the map.
3. Evacuation Center / Voting Precinct – Helps users quickly locate these important sites on Brisk Map.
4. Location Sharing – Enables your admins to locate you when needed. Please note that we don't keep data of your location foot print as our system deletes location data footprint every 24hours.
Call and Message Consent for Brisk Response App -
To improve emergency response and ensure accurate documentation, please review and agree to the following:
1. I consent to the recording and storage of my calls and messages made through Brisk Response for coordination with emergency responders.
2. I understand that these recordings and messages will only be used for app-related purposes whenever needed.
14. Agency's Additional T&C
Registration: Agencies must provide accurate and complete details, including name, contact number, email, and office address. The person registering must be an authorized representative of the agency. Agencies cannot receive or handle incidents without verification.
Verification: Verification requires supporting documents and a valid ID of the agency registrant. Brisk Response reserves the right to reject verification for reasons such as unqualified status or problematic supporting documents.
Subscription for Barangays: For Barangay Access (excluding other agencies) can buy subscription plans to attain Barangay Incident Points in order for their constituents to send reports. Prices may change without prior notice. See Subscription Plans
Subscription for Other Agency Access:Other agency types can purchase additional feature upgrades. Prices may change without prior notice. See Subscription Plans
Refund/Cancellation: All refunds must be requested within 24 hours without any consumption of Barangay Incident Points. Other Agency Feature Upgrades are cancelable/refundable within 3-Days.
Desktop Access - allows you to seamlessly manage your agency with enhanced ease and efficiency using a desktop device. Designed for a smooth and optimized experience, it offers a user-friendly interface and advanced accessibility to maximize productivity. With hardware-locked security, your access remains exclusive to your registered device, ensuring safe and reliable usage.
1. Validity Desktop Access is valid for one (1) year (365 Days) from the date of activation.
2. Hardware Lock & Authorized Use Access is restricted to the registered device only and is secured through a hardware lock. Any attempt to access the software from an unregistered device will be denied.
3. Restrictions and Violations Cracking, tampering, or any unauthorized alterations will result in immediate termination of free maintenance services and may lead to legal action. Unauthorized distribution or cloning of the software will void all maintenance services and will be subject to legal action for unauthorized usage.
4. Refunds and Cancellations Refunds and cancellations are only valid within three (3) days from the date of purchase. Requests beyond this period will not be processed.
5. Coverage & Support We provide free maintenance services for eligible users. Device Transfers: If you wish to transfer access to another device, we will assist with the process. Device Configuration Assistance: If your device undergoes changes that affect access, we will help retrieve your access upon request.

Security: Agencies are responsible for maintaining the confidentiality of their agency access information and all activities that occur under their agency account.
Termination: We reserve the right to suspend or terminate agency access for violations of these terms or for any other reason at our discretion.
Posting of News: When publishing news through the Brisk Response platform, agencies are fully responsible for the accuracy and integrity of the data and information provided. Brisk Response reserves the right to remove any false or unauthorized news publications. You acknowledge that you are accountable for the content you post, and agree that neither the Brisk Response App, its Team, Management, nor FarmTract Technologies Inc. will be held liable for any misinformation or legal consequences resulting from your news submissions. The false news will be deleted from all audience views but will remain in our database for potential legal reference.
Posting of Emergency Alerts: All emergency alerts must be true and accurate. Disseminating false emergency alerts will result in legal liability for the agency. The false alert will be deleted from all audience views but will remain in our database for potential legal reference.
Responders' Responsibility & Accountability:When you open an incident, you take on the responsibility of thoroughly assessing and addressing the reported situation. If, for any reason, you find that you are unable to manage the incident or need to step away, you are required to provide a valid and clear justification for doing so. It is crucial that each incident or emergency report is handled with care, diligence, and professionalism to uphold the trust and safety of our community. Your commitment to these responsibilities ensures that we maintain a reliable and effective response system.

15. Clarification of Roles: Brisk Agents and Customer Care Specialists
Brisk Agents: These agents only intervene in incidents or emergencies if they are queued to them by the system after exceeding the Brisk Agent's Intervention Time-Frame (BAIT). They aid in escalating or helping get the attention of other agencies in such incidents when primary responders are unable to respond within the designated timeframe.
Customer Care Specialists: These specialists assist with non-incident matters such as registration, verification, subscription inquiries, account-related concerns, and agency access navigation. They provide guidance and support to ensure users and agencies have a seamless experience navigating the Brisk Response platform.
16. Intellectual Property Rights
Ownership: All intellectual property rights related to the Brisk Response App, including but not limited to software, content, graphics, logos, and trademarks, are the exclusive property of FarmTract Technologies Inc. or its licensors.
License:By using the app, you are granted a limited, non-exclusive, non-transferable license to access and use the app for its intended purpose. This license does not permit you to copy, modify, distribute, or create derivative works based on the app's content or functionality without prior written consent from FarmTract Technologies Inc.
Restrictions: You may not reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code of the app. Unauthorized use of any intellectual property related to the app may result in legal action.
Feedback: Any feedback or suggestions provided by you regarding the app shall be considered non-confidential and may be used by FarmTract Technologies Inc. for any purpose, including incorporation into future versions of the app, without any obligation or compensation to you.
Enforcement: FarmTract Technologies Inc. reserves the right to enforce its intellectual property rights to the fullest extent permitted by law, including seeking remedies for any infringement.
17. APIs
API Disclaimer: In the event of an API system failure that disrupts communications or transactions, we assume no liability, as API performance is outside of our control. This disclaimer serves as prior notice to clarify that any such disruptions will not be grounds for liability against us. However, our team is committed to minimizing the impact by actively monitoring the outage and exploring alternative fallback APIs to restore service as promptly as possible.

Subscription for Barangays: For Barangay Access (excluding other agencies) can buy subscription plans to attain Barangay Incident Points in order for their constituents to send reports. Prices may change without prior notice. See Subscription Plans
Subscription for Other Agency Access:Other agency types can purchase additional feature upgrades. Prices may change without prior notice. See Subscription Plans
Refund/Cancellation: All refunds must be requested within 24 hours without any consumption of Barangay Incident Points. Other Agency Feature Upgrades are cancelable/refundable within 3-Days.
Desktop Access - allows you to seamlessly manage your agency with enhanced ease and efficiency using a desktop device. Designed for a smooth and optimized experience, it offers a user-friendly interface and advanced accessibility to maximize productivity. With hardware-locked security, your access remains exclusive to your registered device, ensuring safe and reliable usage.
1. Validity Desktop Access is valid for one (1) year (365 Days) from the date of activation.
2. Hardware Lock & Authorized Use Access is restricted to the registered device only and is secured through a hardware lock. Any attempt to access the software from an unregistered device will be denied.
3. Restrictions and Violations Cracking, tampering, or any unauthorized alterations will result in immediate termination of free maintenance services and may lead to legal action. Unauthorized distribution or cloning of the software will void all maintenance services and will be subject to legal action for unauthorized usage.
4. Refunds and Cancellations Refunds and cancellations are only valid within three (3) days from the date of purchase. Requests beyond this period will not be processed.
5. Coverage & Support We provide free maintenance services for eligible users. Device Transfers: If you wish to transfer access to another device, we will assist with the process. Device Configuration Assistance: If your device undergoes changes that affect access, we will help retrieve your access upon request.

Security: Agencies are responsible for maintaining the confidentiality of their agency access information and all activities that occur under their agency account.
Termination: We reserve the right to suspend or terminate agency access for violations of these terms or for any other reason at our discretion.
Posting of News: When publishing news through the Brisk Response platform, agencies are fully responsible for the accuracy and integrity of the data and information provided. Brisk Response reserves the right to remove any false or unauthorized news publications. You acknowledge that you are accountable for the content you post, and agree that neither the Brisk Response App, its Team, Management, nor FarmTract Technologies Inc. will be held liable for any misinformation or legal consequences resulting from your news submissions. The false news will be deleted from all audience views but will remain in our database for potential legal reference.
Posting of Emergency Alerts: All emergency alerts must be true and accurate. Disseminating false emergency alerts will result in legal liability for the agency. The false alert will be deleted from all audience views but will remain in our database for potential legal reference.
Responders' Responsibility & Accountability:When you open an incident, you take on the responsibility of thoroughly assessing and addressing the reported situation. If, for any reason, you find that you are unable to manage the incident or need to step away, you are required to provide a valid and clear justification for doing so. It is crucial that each incident or emergency report is handled with care, diligence, and professionalism to uphold the trust and safety of our community. Your commitment to these responsibilities ensures that we maintain a reliable and effective response system.
Shared Media Contents: Any media content (photos, videos, etc.) shared, uploaded, or provided by users on the Brisk Response App is the sole responsibility of the user who shares it. Brisk Response App disclaims any liability for such content. This includes, but is not limited to, any media that captures individuals, groups, or entities, whether directly or indirectly, intentionally or unintentionally. Users are fully accountable for ensuring that their shared content complies with privacy and consent standards.
Brisk Map – Location Consent: By using Brisk Map, you consent to the app collecting your location for the following purposes:
1. Home Address – Used for reporting incidents and emergencies. This information will be shared with your chosen responders and any agencies handling escalations.
2. Agency Address – Allows users to easily find your office on the map.
3. Evacuation Center / Voting Precinct – Helps users quickly locate these important sites on Brisk Map.
4. Location Sharing – Enables your admins to locate you when needed. Please note that we don't keep data of your location foot print as our system deletes location data footprint every 24hours.
Call and Message Consent for Brisk Response App -
To improve emergency response and ensure accurate documentation, please review and agree to the following:
1. I consent to the recording and storage of my calls and messages made through Brisk Response for coordination with emergency responders.
2. I understand that these recordings and messages will only be used for app-related purposes whenever needed.
15. Clarification of Roles: Brisk Agents and Customer Care Specialists
Brisk Agents: These agents only intervene in incidents or emergencies if they are queued to them by the system after exceeding the Brisk Agent's Intervention Time-Frame (BAIT). They aid in escalating or helping get the attention of other agencies in such incidents when primary responders are unable to respond within the designated timeframe.
Customer Care Specialists: These specialists assist with non-incident matters such as registration, verification, subscription inquiries, account-related concerns, and agency access navigation. They provide guidance and support to ensure users and agencies have a seamless experience navigating the Brisk Response platform.
16. Intellectual Property Rights
Ownership: All intellectual property rights related to the Brisk Response App, including but not limited to software, content, graphics, logos, and trademarks, are the exclusive property of FarmTract Technologies Inc. or its licensors.
License:By using the app, you are granted a limited, non-exclusive, non-transferable license to access and use the app for its intended purpose. This license does not permit you to copy, modify, distribute, or create derivative works based on the app's content or functionality without prior written consent from FarmTract Technologies Inc.
Restrictions: You may not reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code of the app. Unauthorized use of any intellectual property related to the app may result in legal action.
Feedback: Any feedback or suggestions provided by you regarding the app shall be considered non-confidential and may be used by FarmTract Technologies Inc. for any purpose, including incorporation into future versions of the app, without any obligation or compensation to you.
Enforcement: FarmTract Technologies Inc. reserves the right to enforce its intellectual property rights to the fullest extent permitted by law, including seeking remedies for any infringement.
17. APIs
API Disclaimer: In the event of an API system failure that disrupts communications or transactions, we assume no liability, as API performance is outside of our control. This disclaimer serves as prior notice to clarify that any such disruptions will not be grounds for liability against us. However, our team is committed to minimizing the impact by actively monitoring the outage and exploring alternative fallback APIs to restore service as promptly as possible.
